Professional and General Liability Insurance Summary of Terms & Conditions Eligibility

The THOMCO Professional and General Liability Program is designed to provide professional and general liability insurance for personal trainers and exercise instructors who are classified as "independent contractors." This policy is for individuals only.

Costs

Annual cost for accredited certified personal trainers and group exercise instructors is $165.
Annual cost for all other personal trainers is $250. Note: Cost includes premiums for insurance and enrollment in the National Health Club Association Purchasing Group.

Special Requirements

All instructors and trainers must complete an application to obtain coverage. Items such as certification and experience are taken into consideration for approval. This program is not available in Canada or Puerto Rico.

Coverage

This policy will cover damages should you become legally obligated to pay for "bodily injury" and "property damage" caused by your negligence while engaging in a personal training session or group instruction. The company will have the right to defend you against any "suit" seeking such damages. However, the insurance company will have no duty to defend you against a claim that is not covered under the policy.

Policy Limits of Coverage

The annual aggregate limit of liability coverage is $3,000,000, with a per occurrence limit of $1,000,000.

Exclusions (Not Covered)

The following activities and/or operations are not included within the Professional and General Liability Program and are therefore not covered:

• Chiropractic Treatments
• Trampoline
• Gymnastics
• Massage Therapy
• Rock Climbing
• Physical Therapy
• Products You Manufacture
• Cheerleading
• Diet Guarantees
• Medical Treatments
• Disclosure

You hereby warrant, represent and confirm that, to the best of your knowledge, all information provided is complete, true, and correct.

THOMCO, as managing general underwriter for the insurance company, receives compensation from the insurance company in consideration for its performance of services that include, but are not limited to: underwriting, policy issuance, administrative functions, and claims handling. Additional compensation is received for administration of the National Health Club Association Purchasing Group to provide additional benefits and discounts unrelated to insurance for all participants in this program.

You understand the premium is not fully earned but the membership fee is fully earned. Return premium will be calculated on a short rate basis should you request your coverage to be canceled within the policy term. The membership fee is fully earned and will not be returned.

It is understood that intentional misrepresentation on the enrollment application may jeopardize coverage.

Further, you acknowledge that you have reviewed the exclusions and operations for which coverage is not provided.
